Vape Law Guide Ireland 2026: Tax, Licensing, and New Rules

Vaping laws in Ireland have undergone a major shift as of 2026. Under the Public Health (Tobacco Products and Nicotine Inhaling Products) Act 2023 and the 2026 Amendment Bill, the industry now operates under a strict system of taxation, licensing, and standardised display rules.

Age Restrictions and Verification

Vaping is legal in Ireland for adults aged 18 and over. Selling any nicotine inhaling product to a minor is a serious criminal offence.

Online Sales: Retailers are required by law to use robust age verification at the point of sale. 
Scope: These rules apply to all hardware, nicotine-containing liquids, and nicotine-free e-liquids.

The E-Liquid Products Tax (EPT)

Following the legislation introduced in late 2025, all e-liquids sold in Ireland are now subject to a flat excise duty.

The Rate: €0.50 per ml of e-liquid. 
The Impact: This adds €5.00 in tax to every 10ml bottle before the base price and VAT are applied. 
Applicability: This tax applies to all liquids regardless of nicotine content, including shortfills and nicotine-free pods.

HSE Retail Licensing (Effective Feb 2, 2026)

The old one-time registration fee has been replaced by a mandatory annual licensing system.

Mandatory Licence: Since 2 February 2026, every shop and website must hold a specific HSE licence to sell nicotine inhaling products. 
Cost: The annual fee is €800 per licence.

Product Standards and TPD Compliance

All products on the Irish market must comply with the Tobacco Products Directive (TPD) and national safety laws:

Nicotine Cap: Maximum 20mg/ml nicotine strength. 
Bottle Volume: Maximum 10ml for refill containers. 
Tank Capacity: Maximum 2ml for tanks and pods. 
Safety: Products must be child-resistant and tamper-evident.


The Legislative Roadmap: Planned Regulatory Changes

While current laws focus on licensing and taxation, the Irish Government is currently progressing the Public Health (Amendment) Bill 2026. It is important to note that these measures are not yet in effect and are currently being debated in the Oireachtas.

Proposed Retail Restrictions: The Bill seeks to ban the point-of-sale display of products in mixed retail outlets such as supermarkets and garages.

Advertising Prohibition: There is a planned ban on advertising these products in all retail environments and on public-facing websites.

Appearance and Design: The government intends to restrict the use of bright colours and imagery on packaging and devices.

Standardised Flavour Names: Future rules aim to limit e-liquid descriptions to basic terms such as TOBACCO or UNFLAVOURED.
